Help
us spread the word about the amazing results that folks can find
in feeding fresh, real foods to their pets, and earn a 15% commission
of each product purchased from our website.
Simply
place a text link or banner for Sojourner Farms® on your
website. When a customer clicks on the link and places an order
with us, you'll receive a 15% commission on their entire order.
And every time that customer orders again in the future from
the same computer you'll keep receiving your 15% commission.
How do you track sales?
1.
You are assigned a unique associate number and password.
2.
You receive instant email notification the second a sale is made.
3.
You can view your customer counts, sales counts, historical reports
and all commissions in real time 24 hours day.
When is commission paid?
Your
commissions will be paid on a monthly basis provided they are
greater than $50. If commissions are less than $50, they will
be rolled over onto the next month until the total amount exceeds
$50.
What about banners and links for your site?
We
currently have banners available in text and/or graphics. After
you sign up for the program, we'll supply you with a link to a
page with banners and text links to use on your site. Everything
about our Associate Program is designed with you in mind. We
take care of credit card charges, we ship the product, we take
care of customer service questions and all the administration. All
you do is post a link to our site and earn referral fees.
What does this cost me?
Absolutely
nothing! There are no set up fees! All you need is a website.
SOJOURNER FARMS®ASSOCIATE AGREEMENT----TERMS
AND CONDITIONS
ASSOCIATE WEB
SITE APPROVAL CRITERIA: Sojourner Farms® reserves the right to reject any site based
on the following criteria: Sexually explicit or adult oriented,
promotion of violence, illegal or borderline illegal activities,
copyright violations or sites that we choose to not be associated
with. Websites receiving initial approval for the Associate Program
of Sojourner Farms® will be periodically checked for continued
compliance. Any Associate's website found to be no longer in
compliance will be notified immediately of possible termination
of participation and all future referral fees and all related
items deemed "benefits" of the Associate Program of
Sojourner Farms®.
TERMS OF THIS AGREEMENT: The term
of this agreement begins at the time you are accepted until cancelled
by either party. Commissions earned through the date of expiration
or cancellation of this agreement will remain payable only if
the qualifying sales are not cancelled by the customer. Payment
of the final commission payment to the Associate may be withheld
for a reasonable time in order to ensure that the correct amount
is paid.
DISCLAIMER: Sojourner Farms® will
make every reasonable effort to track and pay commissions for
all sales that apply to associate. However, Sojourner Farms® is
not responsible for technical problems, acts by third parties,
or other events outside our reasonable control which may temporarily
disrupt or diminish this service.
INDEPENDENT
CONTRACTOR: The
relationship between Sojourner Farms® and Associate established
by this agreement is that of independent contractors. Associate
and Sojourner Farms®shall each conduct its respective business
at it own initiative, responsibility and expense and shall have
no authority to incur any obligations on behalf of the other,
except as otherwise provided herein. The term "Associate" shall
not be interpreted as a legal partner or associate, simply as
an independent contractor for Sojourner Farms® under this
agreement. As such all Associates will be responsible for their
own taxes and any other tax liabilities that affect sales of
our product in the Associate's respective state or country. Nothing
in this agreement will create any partnership, joint venture,
agency, franchise, sales representative or employment relationship
between the parties. You will have no authority to make or accept
any offers or represent on Sojourner Farms'® behalf. You
may not make any statement, whether on your site or otherwise,
that would contradict anything in this section.
COMMISSIONS: Our
payment (commissions) to you is a percentage of the gross amount
that you or the person
you referred spent online at our web sites, after following a
link to our website, from your website. We will not make a referral
payment for any transaction for which payment has not been fully
received or for any transaction that has been rejected for any
reason. We are not responsible for paying interest to the Associate
for accrued, but not yet delivered referral payments. If any
transaction incurs a chargeback or if the online transaction
is not completed in every way, no commission payments are due
to the Associate. If one has already been paid, then it will
be deducted from an active Associate's accrued referral payment;
otherwise it will become due immediately from the Associate (or
former Associate).
PRIVACY: To protect Sojourner
Farms'® customer privacy, we cannot provide identifying customer
names and contact information to you. However, we will provide
an online report detailing price, service, date of sale and perhaps
other data for your records.
LIMITATION
OF DAMAGES: Sojourner
Farms® shall not be held liable for any indirect, incidental,
special or consequential damages or any loss of revenue or profits
arising under or with respect to this agreement or program, even
if Sojourner Farms® has been advised of the possibility of
such damages. Sojourner Farms® aggregate liability arising
under or with respect to this agreement or the program shall
in no event exceed the total commissions paid or payable by the
Sojourner Farms® under this agreement.
SPAMMING OR
UNSOLICITED EMAIL: Sojourner
Farms® expressly forbids the sending of unsolicited commercial
email. The sending of unsolicited email will result in immediate
removal from the Associate Program.
MODIFICATION
OF THIS ASSOCIATE AGREEMENT : This agreement may be modified at any time by Sojourner
Farms®, in its sole discretion, by modifying our web sites.
Continued participation in the Associate Program constitutes
an agreement with its then current rules and information, posted
at our web sites.
WARRANTY DISCLAIMER: Sojourner
Farms® makes no warranties expressed or implied with regard
to the Associate Program except as outlined in this agreement.
GOVERNING LAW: This
agreement shall be governed by the laws of the State of Minnesota
and the
United States of America.
